Title I – General Provisions

Chapter 1.01 – Code Adoption

Sec. 1.01.001 Adoption

This Code of Ordinances shall be known and cited as the “Code of Ordinances, City of Mingus, Texas.” It consolidates all general and permanent ordinances of the City into an organized, accessible format for official reference.

Sec. 1.01.002 Effect of Adoption

All prior ordinances of a general and permanent nature not included in this Code are hereby repealed, except those specifically continued in force or referenced herein.

Sec. 1.01.003 Effective Date

This Code shall become effective immediately upon final passage and publication as required by law.

Chapter 1.02 – Definitions and Rules of Construction

Sec. 1.02.001 Rules of Interpretation

The following rules apply to the construction of this Code unless the context clearly indicates otherwise:

Words in the singular include the plural, and vice versa.
Words importing one gender include all genders.
“Shall” is mandatory and “may” is permissive.
“Person” includes any individual, firm, partnership, corporation, or other entity.
Headings and captions are for convenience only and do not affect interpretation.

Sec. 1.02.002 Definitions

City – The City of Mingus, Texas.
City Council – The governing body of the City of Mingus.
Mayor – The duly elected Mayor of the City of Mingus.
Official – Any officer or employee of the City acting in an official capacity.
Ordinance – A law adopted by the City Council of Mingus.

Chapter 1.03 – General Penalty

Sec. 1.03.001 Penalty

Unless otherwise specified, any person violating a provision of this Code shall be guilty of a misdemeanor and subject to a fine not exceeding $500. For ordinances relating to fire safety, zoning, public health, or sanitation, the fine may not exceed $2,000.

Sec. 1.03.002 Separate Offenses

Each day any violation continues shall constitute a separate offense.

Sec. 1.03.003 Enforcement

The City Administrator, City Attorney, and peace officers of the City are authorized to enforce all provisions of this Code.

Chapter 1.04 – Severability and Repealer

Sec. 1.04.001 Severability

If any section or provision of this Code is held invalid, the remainder shall continue in full force and effect.

Sec. 1.04.002 Repealer

All prior ordinances or parts thereof in conflict with this Code are hereby repealed to the extent of such conflict.

Chapter 1.05 – Amendment and Supplementation

Sec. 1.05.001 Amendments

New ordinances of a general and permanent nature shall be numbered, codified, and incorporated into this Code under the direction of the City Secretary.

Sec. 1.05.002 Supplementation

The City Secretary shall maintain a master copy of the Code and update it following the adoption of each amendment or new Title.

Sec. 1.05.003 Distribution

This Code shall be available for inspection at City Hall and may be posted electronically on the official City website for public access.
