This Title establishes minimum standards for construction, alteration, maintenance, and demolition of buildings and structures within the City of Mingus to promote public health, safety, and general welfare.
The City adopts by reference the most current editions of the International Building Code (IBC), International Residential Code (IRC), and International Fire Code (IFC), as amended by the City Council. Where conflicts arise, local amendments shall control.
The City may rely on Palo Pinto County inspectors or contracted officials for plan review and inspection services. Building permits issued under this Title are subject to verification of compliance with county and state codes.
No person shall erect, construct, alter, or relocate any building or structure without first obtaining a building permit from the City. Exemptions include routine maintenance, painting, and minor repairs not affecting structural integrity or life safety.
The City or its designated inspector shall review each application for compliance with adopted codes. Approvals may require verification of septic or utility service readiness.
No structure may be occupied or used until the City has issued a Certificate of Occupancy verifying compliance with this Title and applicable health and safety requirements.
The City adopts by reference the National Electrical Code (NEC), International Plumbing Code (IPC), and International Mechanical Code (IMC), as amended by the State of Texas.
All electrical, plumbing, and HVAC work must be performed by contractors licensed by the State of Texas. Homeowners may perform minor work on single-family dwellings they personally occupy, subject to permit and inspection.
Installations must conform to state and national standards to prevent fire, shock, contamination, or injury. The City may halt work not performed safely or by qualified personnel.
All property owners must maintain buildings in sound condition, weatherproof, and free from unsafe defects. Exterior surfaces visible from public rights-of-way must be kept in good repair and free of hazards.
Structures that are dangerous to life, health, or property may be declared unsafe by the City. After notice, the owner must repair, secure, or demolish the building within a specified time. If the owner fails, the City may abate the hazard and assess costs as a lien.
Any person removing or demolishing a structure must first obtain a demolition permit and ensure disconnection of all utilities.
Manufactured or mobile homes may be placed only in designated areas or lots approved for residential use. Placement requires a City permit and compliance with Texas Occupations Code Chapter 1201.
Mobile homes not meeting HUD safety standards or state age limits may not be relocated into the City limits. Existing units are grandfathered if safely maintained.
The Building Official, City Administrator, or designee shall enforce this Title. Work performed without a permit may be ordered stopped until compliance is achieved.
Any person violating provisions of this Title is guilty of a misdemeanor and upon conviction shall be fined up to $2,000 per offense. Each day the violation continues constitutes a separate offense.
Decisions of the Building Official may be appealed to the City Council or designated Board of Adjustments within ten (10) days of notice.
If any section of this Title is held invalid, the remaining provisions shall remain in full force and effect.
