Title XIV – Public Property and Facilities

Chapter 14.01 – General Provisions

Sec. 14.01.001 Purpose

This Title provides regulations for the use, management, and preservation of public property and facilities owned by the City of Mingus, Texas.

Sec. 14.01.002 Authority

These provisions are enacted under the City’s home-rule powers and the Texas Local Government Code for the protection of public assets and to ensure fair and efficient use by all residents.

Sec. 14.01.003 Definitions


Chapter 14.02 – Use of City Facilities

Sec. 14.02.001 Public Access

City facilities shall be open to the public during posted business hours, subject to reasonable restrictions for safety, maintenance, and authorized activities.

Sec. 14.02.002 Rentals and Reservations

Use of City facilities for private events requires advance reservation and payment of any applicable fees or deposits as established by Council resolution.

Sec. 14.02.003 Damage or Misuse

Any person who damages or defaces City property shall be liable for repair costs and may be cited for violation of this Code.

Sec. 14.02.004 Alcohol and Tobacco Use

Consumption of alcohol or tobacco on City property is prohibited except under written permit approved by the City Council.


Chapter 14.03 – Maintenance and Improvements

Sec. 14.03.001 Maintenance Responsibility

The City Administrator shall ensure regular maintenance of all City property and facilities, coordinating with departments, contractors, or volunteers as necessary.

Sec. 14.03.002 Capital Improvements

New construction, major renovations, or capital improvements to City facilities shall be authorized by the Council through the annual budget or by special appropriation ordinance.

Sec. 14.03.003 Donations of Property or Labor

The City may accept gifts or donations of materials, labor, or improvements to public property, provided such donations are approved by the Council and meet City standards.


Chapter 14.04 – Streets, Alleys, and Easements

Sec. 14.04.001 Street Ownership and Control

All streets, alleys, and public rights-of-way within the corporate limits are under the jurisdiction of the City Council.

Sec. 14.04.002 Street Closures and Abandonment

No public street or alley shall be vacated or abandoned except by ordinance following public notice and hearing. The Council may require payment for the fair market value of vacated property.

Sec. 14.04.003 Encroachments

No person shall construct or place any structure, sign, or obstruction within a City right-of-way without written authorization.


Chapter 14.05 – Parks and Public Grounds

Sec. 14.05.001 Public Parks

The City maintains public parks for recreational use and community benefit. Use shall comply with posted rules, hours, and City ordinances under Title V – Parks and Recreation.

Sec. 14.05.002 Park Improvements

All permanent improvements or installations on park property require Council approval. Temporary events or decorations must not damage grounds or facilities.

Sec. 14.05.003 Protection of Vegetation

No person shall remove or damage trees, shrubs, or landscaping on public property without written consent from the City Administrator.


Chapter 14.06 – City Buildings and Equipment

Sec. 14.06.001 Security

City buildings shall be secured outside of business hours. Access keys or codes shall be issued only to authorized personnel and tracked by the City Administrator.

Sec. 14.06.002 Equipment Use

City-owned vehicles, tools, or machinery shall be used solely for official purposes. Personal or unauthorized use is prohibited.

Sec. 14.06.003 Inventory and Disposal

The City shall maintain an inventory of all equipment and capital assets. Surplus property may be disposed of by auction, trade-in, or sale as approved by the Council.


Chapter 14.07 – Naming of Public Property

Sec. 14.07.001 Authority

The City Council retains exclusive authority to name or rename public buildings, streets, and facilities.

Sec. 14.07.002 Public Input

Names may be proposed by citizens or organizations and shall be considered at a public meeting before adoption.

Sec. 14.07.003 Criteria

Names shall reflect local history, geography, or persons of distinguished public service to the City of Mingus.


Chapter 14.08 – Enforcement and Penalties

Sec. 14.08.001 Enforcement

The City Administrator, law enforcement officers, and authorized employees shall enforce this Title. Violations may result in citations, loss of privileges, or civil penalties.

Sec. 14.08.002 Penalties

Violations are misdemeanors punishable by fines up to $500 per offense, plus restitution for damages to City property.

Sec. 14.08.003 Severability

If any provision of this Title is found invalid, the remaining provisions shall continue in effect.
