This Title provides for the establishment, maintenance, and regulation of public parks, recreation areas, and community facilities within the City of Mingus, ensuring their safe and enjoyable use by residents and visitors.
This Title is enacted under the City’s home-rule powers and Chapters 331 and 332 of the Texas Local Government Code, authorizing municipalities to provide public parks and recreation programs.
City parks shall be open to the public from sunrise to sunset unless otherwise designated by the City. Overnight camping or loitering is prohibited without written authorization.
The possession or consumption of alcoholic beverages, drugs, or controlled substances is prohibited in all City parks except by special permit approved by the City Council for designated events.
The discharge of firearms, air rifles, fireworks, or similar devices within any park is prohibited except as part of City-authorized programs or emergency response.
No person shall deposit trash, refuse, or debris in any park except in designated containers. Dumping of household or construction waste is strictly prohibited.
No person shall deface, injure, or remove any tree, shrub, building, fence, or equipment within any City park. Vandalism shall be prosecuted to the fullest extent of law.
Park pavilions, fields, and facilities may be reserved for private or public events through the City Administrator’s office. Reservations shall be made at least seven (7) days in advance with payment of applicable fees and deposits.
Fees for facility use, event permits, or deposits shall be set by the City Council by resolution and listed in the City’s Fee Schedule (Appendix A).
Refunds may be issued for cancellations made more than 48 hours in advance. Events canceled by the City due to weather or emergencies will be refunded in full.
The City Council shall periodically review the adequacy of existing parks and identify potential locations for new facilities consistent with the Comprehensive Plan.
The City may accept land, funds, or improvements donated for park development. Recognition plaques or signage may be approved by Council resolution.
All parks shall be maintained in a safe, clean, and attractive condition. Citizens are encouraged to report damage or maintenance issues to City Hall.
The City may temporarily close a park or facility for maintenance, weather, or public safety. Notice shall be posted at entrances or the City website.
Peace officers and other authorized personnel shall enforce the provisions of this Title. Park violations may result in removal from the premises or issuance of a citation.
Violations of this Title are misdemeanors punishable by fines not exceeding $500 per offense. Acts involving damage to City property may be fined up to $2,000 as allowed by law.
If any section or provision of this Title is held invalid, the remainder shall remain in effect.
